Quality Cars Kenya ("we", "us", "our") respects your privacy. This policy explains what information we collect when you visit our website, enquire about a car, list a car for sale with us, or meet us for a viewing, and how we keep that information safe. It is written to comply with the Kenya Data Protection Act, 2019 and the regulations made under it.
If anything here is unclear, call us on +254 799 508 211 or email qualitycarskenya1@gmail.com. You can also use our contact form.
1. Who we are
Quality Cars Kenya is a motor-vehicle dealer operating in Kenya. For the purposes of the Data Protection Act, we are the data controller of the personal information you share with us.
2. What information we collect
We only collect what we need to do our job. In practice, that is:
- Information you give us through the website. Your name, phone number, email address, the message you type, and (if you send one) the car you are enquiring about.
- Information you give us when listing your car. The car's details (make, model, year, mileage, asking price), your contact details, and any photos or notes you share.
- Information you give us by phone, WhatsApp, email or in person. We keep a basic record of the conversation so our team can follow up.
- Information needed to transfer ownership. If you buy or sell a car with us, we will need your national ID, KRA PIN and the vehicle logbook so NTSA can process the transfer. We do not ask for this until the sale is agreed.
- Basic technical information. Our hosting provider receives standard web-server logs (IP address, browser type, pages visited, time of visit) so the site can function and we can defend against abuse. We do not use advertising cookies and we do not run advertising or social-media tracking pixels on this site.
- Website statistics. We use Google Analytics to see how visitors use the site: pages viewed, approximate location (city or country), device and browser type, and clicks on our WhatsApp and phone buttons or contact forms. Google Analytics only runs if you click "Accept" in our cookie banner; until then (or if you decline) it is not loaded at all and nothing is sent to Google. Google Analytics is provided by Google; see Google's privacy policy. We use these statistics only to improve the website.
We do not knowingly collect information from children under 18. If you believe a child has sent us information, please contact us and we will delete it.
3. Why we use it (lawful basis)
We only use your information for a specific, lawful reason:
- To respond to your enquiry about a car, financing timeline, or a listing (basis: your consent and taking steps at your request before entering a contract).
- To market your car on your behalf when you list it with us — creating the listing, screening buyer enquiries, scheduling viewings and closing the sale (basis: the contract between us).
- To process a sale and transfer ownership with NTSA, KRA and any lender involved (basis: contract and our legal obligations).
- To keep accurate business records such as receipts and sale documents (basis: our legal obligations, including under tax law).
- To keep the website running and secure and to detect fraud or abuse (basis: our legitimate interests in operating a safe service).
We will never sell, rent or trade your personal information. We will not add you to marketing lists without your consent.
4. Who we share it with
Your information stays within our team unless we have a clear reason to share it:
- Buyers viewing your listed car — only the details you have agreed we can publish (your car's photos and specs). We do not publish your name, phone number or home address on the listing.
- Government bodies — NTSA (for logbook transfer), KRA (for tax), and the National Police Service only where required by law or a lawful order.
- Service providers that help us operate, such as our website host, email provider and WhatsApp Business. They are bound to use your information only to deliver their service to us.
- Our professional advisors (for example, auditors or lawyers) under a duty of confidentiality, and only where necessary.
If any of our providers are based outside Kenya, we only use providers that offer safeguards in line with the Data Protection Act's rules on cross-border transfers.
5. How long we keep it
- Website enquiries that do not become a sale: up to 12 months, then deleted.
- Listed-car records (seller details, car details, buyer enquiries): for as long as the car is listed and up to 24 months after the listing closes.
- Sale records (sale agreements, receipts, logbook transfer documents): at least 7 years, as required by tax and accounting law in Kenya.
- Web-server logs: up to 90 days.
6. How we keep it safe
- Our website runs over HTTPS so information you send is encrypted in transit.
- Admin access is password-protected; only authorised staff can see enquiries and listings.
- Original documents (logbooks, IDs) are only handled when needed for a sale and are returned or securely filed once the transfer is complete.
- We take regular backups and keep them in a secure location.
No system is perfectly secure. If a breach ever affects your information in a way that is likely to put you at risk, we will notify you and the Office of the Data Protection Commissioner (ODPC) as required by the Act — normally within 72 hours of becoming aware of it.
7. Your rights
Under the Data Protection Act, 2019 you have the right to:
- Be told what personal information we hold about you and why;
- Receive a copy of that information in a usable format;
- Have inaccurate information corrected;
- Ask us to delete your information where we no longer have a lawful reason to keep it;
- Object to or restrict how we use your information in certain cases;
- Withdraw a consent you previously gave (without affecting anything we did before you withdrew it);
- Complain to the Office of the Data Protection Commissioner (odpc.go.ke) if you believe we have mishandled your information.
To exercise any of these rights, contact us using the details below. We will respond within 30 days. There is no charge, unless a request is clearly excessive, in which case we will explain any cost before proceeding.
8. Cookies and similar technologies
This website uses a small number of strictly necessary technologies to keep the site working — for example, remembering a search filter during your visit. These do not need your consent.
Google Analytics cookies are only used with your consent. When you first visit, a banner asks whether you accept analytics cookies. Until you click "Accept", Google Analytics is not loaded at all: no analytics cookies are set and no information is sent to Google. If you accept, Google Analytics sets first-party cookies (named _ga and _ga_…, kept for up to 2 years) to count visits and understand how the site is used (see section 2).
We remember your choice in your browser. You can change it at any time with the Cookie settings link at the bottom of every page (if you withdraw consent, Google Analytics stops and its cookies are deleted), or by deleting cookies and site data in your browser settings. You can also use Google's opt-out add-on.
This website does not use advertising cookies, social-media tracking pixels or cross-site profiling.
9. Links to other websites
Our site may link to other websites — for example, Google Maps, WhatsApp or a social-media page. We are not responsible for the privacy practices of those sites; please read their own policies before sharing information with them.
10. Buying and selling: what you can expect from us
We want both buyers and sellers to feel safe dealing with us. In addition to the data-protection commitments above:
- Buyers: every car we list has been inspected and the mileage and history confirmed to the best of our ability. We give honest, written answers to your questions and will not misrepresent a car's condition. The price shown is the price we discuss — there are no hidden fees from us.
- Sellers who list with us: we market your car on your behalf; we do not transfer ownership or receive payment on your behalf without a signed written agreement. You stay in control of the asking price. We will not share your personal details publicly on the listing.
- Payments: make all payments to the account we provide in writing. We will never ask you to send money through a personal mobile-money number, nor to pay a "release fee" to a third party. If anyone claiming to be from Quality Cars Kenya asks you to do this, stop and call us on the number at the top of this page to confirm.
- Final-sale documentation: every completed sale is backed by a written sale agreement signed by the buyer, the seller and ourselves. Keep your copy — it protects everyone.
11. Limits of our role
Quality Cars Kenya acts as a motor-vehicle dealer and, when you list a car with us, as an agent marketing your car on your behalf. We are not a bank, insurance company, inspector-of-record or NTSA agent. Any statutory inspection, insurance cover or ownership transfer is subject to the policies of the relevant authority or provider. Nothing on this website is intended as legal, tax or financial advice.
12. Changes to this policy
We may update this policy from time to time. The "last updated" date at the top shows when it was last changed. If a change materially affects how we use your information, we will highlight that change at the top of this page for a reasonable period.
